Hyderabad,Dec 1 (INN): A division bench of Andhra Pradesh High Court on Tuesday quashed a petition filed against K Rosaiah’s appointment as caretaker Chief Minister of Andhra Pradesh after the sudden demise of former chief minister Y S Rajasekhara Reddy.A division bench of the High Court felt that since Rosaiah has now been elected leader of the Congress Legislature Party,he is eligible to become the Chief Minister and can take major decisions concerning the state.Advocate A Ravi had filed the petition in the High Court stating that Rosaiah cannot take major decisions without proving his majority in the House.Rosaiah also cannot be termed the Chief Minister without proving his majority.


He pointed out that Mr Rosaiah was not elected as the Legislative Party leader even though he belongs to the Congress and did not submit the list of MLAs supporting him to the Governor to show his majority.The petitioner even appealed to the court to restrain Mr Rosaiah from taking any decisions as “they are not valid since the Chief Minister does not enjoy the support of the House.” He wanted the Chief Secretary to call for a Congress Legislature Party (CLP) meet in order to elect a leader of their choice who will finally take up the reins of the State.
